These Terms of Service (“Terms”) govern your access to and use of the Malcom platform, website, and services (the “Service”), provided by Malcom technology OÜ (“Malcom,” “we,” “us,” or “our”).
By accessing the Service, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a school, district, or company, you represent that you have the authority to bind that entity.
Malcom provides an AI-driven “layer” for traditional learning materials. The Service includes virtual classrooms, AI-powered tutoring conversations, adaptive learning feedback, and progress tracking/grade prediction tools.
Eligibility: If you are a student, you may only use the Service if your school or teacher has created an account for you.
Security: Users are responsible for maintaining the confidentiality of their login credentials.
Authorized Use: You agree not to use Malcom for any purpose that is unlawful or prohibited by these Terms.
Nature of AI: Malcom utilizes advanced Artificial Intelligence to interact with students. While we strive for high accuracy, AI-generated content may occasionally contain errors or inconsistencies.
Educational Tool: Malcom is a supplemental educational tool. Grade predictions and AI feedback are provided for informational purposes to assist educators. Final educational assessments and grading decisions remain the sole responsibility of the human educator.
Output Ownership: Subject to our Privacy Policy, students and schools retain rights to their original input, while Malcom retains ownership of the underlying AI architecture and Service improvements.
Our Content: The Malcom logo, software, AI models, and website design are the exclusive property of Malcom.
Your Materials: Teachers and schools retain all ownership rights to the original textbooks, workbooks, and lesson plans they upload. By uploading materials, you grant Malcom a limited, non-exclusive license to process those materials solely to provide the Service to you.
Users agree not to:
Attempt to reverse-engineer or “jailbreak” the AI to produce inappropriate or harmful content.
Use the Service to generate spam, defamatory content, or infringing materials.
Interfere with the security or integrity of the platform.
Our processing of your data is governed by our Privacy Policy. For users in the EU, we comply with GDPR. For users in the US, we comply with FERPA and COPPA. Schools acknowledge that they are responsible for obtaining necessary parental consent before allowing students under 13 to use the Service.
To the maximum extent permitted by law, Malcom shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the AI service, including but not limited to inaccuracies in AI-generated responses or grade predictions.
We reserve the right to suspend or terminate your access to the Service if you violate these Terms or if your school’s subscription expires. Upon termination, we will handle your data according to our data retention policy.
These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in the courts of Estonia.
